The Trusts of Land and Appointment of Trustees Act 1996 (known as TOLATA) gives the court certain powers to resolve property ownership disputes, including:
- forcing a sale of a property
- determining the party’s respective shares in a property
- allowing a party to reoccupy the former family home if the other party refuses to leave.
- allowing a party’s parent or grandparent to recover their financial interest in a property
Disputes often arise when a couple separate who have not married and the share and contribution to the purchase, upkeep and maintenance of a property is not clear. It is particularly relevant in the property is registered in the sole name of one of the parties.
Another increasingly common situation is where parents have contributed to the purchase of a property without formal agreement or an interest being registered at the land registry.
